Kaufland's store in Burgas missed a fine of BGN 1,000 after the District Court in the seaside town overturned the sanction imposed on the hypermarket in establishing the sale of spoiled food.
Burgas-based Kaufland, located in the Slaveykov district of the city, has been selling chicken sausages and millet in rural areas, which expired a week ago.
Old Panagyurishte sausages and sour kefir were also found in the windows of Kaufland.
The inspection of the Kaufland in Burgas was carried out on April 15 this year, and the state inspectors added that along with the spoiled food, the customers were offered goods whose packages were opened.
White pickled cheese, meat delicacies and shredded cow's milk cheese, which was produced in Bulgaria, were sold in open packages.
Customers also say that some Dutch dairy products and frozen baby herring from Poland did not appear to be edible.
A statement of findings was drawn up on the day of the inspection against the food chain. An act for destruction of foodstuffs was also issued. After reviewing the protocol, the state institutions imposed a fine of BGN 1,000 on Kaufland.
Although the amount is low for a large food chain like Kaufland, the Burgas store appealed the decision for a fine, taking the case to the District Court - Burgas.
According to the managers of the hypermarket, the sale of spoiled food does not deserve to be fined. However, spoiled food has been described to representatives of the food chain.
"It is inadmissible only in the penal decree to indicate for the first time facts that have not been presented to the offender with AUA" - said in the decision of the District Court, which overturned the fine of BGN 1,000 for Kaufland.
On the other hand, the Commission for Protection of Competition fined the hypermarkets in the German food chain in Bulgaria for misleading advertising. Kaufland has to pay the sum of BGN 542,662.50 for the misleading advertising of the K-Classic food products.
In fact, it turned out that the announced lowest prices in the region were not.
