Another fine for participating in a cartel for the price of oil was taken by a recidivist company. Zvezda AD was fined a substantial amount of BGN 85,673 for its agreement with COOP Trade and Tourism for a maximum final price of the oil. The second infringing company will have to deposit BGN 76,154 in the treasury.

This is another decision of the Commission for Protection of Competition (CPC) against oil companies. In the reasons for their decision against the two companies, the CPC reported that the companies had violated the competition law by concluding a prohibited vertical agreement.

The contracts concluded between them are indicated as evidence, in which the distributors are envisaged to comply with the pricing policy of Zora AD and especially with the final recommended prices. That disputed clause in the distribution agreement actually regulates the obligation of distributors to adhere to final selling prices.

It is not the first time that Zvezda AD has resorted to such unethical commercial practices. As early as 2008, the company was among the first to be fined for a production and price cartel. Then the Supreme Administrative Court (SAC) imposed fines of BGN 893 thousand on 8 companies.

Three months ago, the CPC again targeted Zvezda AD, Kaliakra AD and Biser Oliva AD, which were accused of concluding prohibited agreements with their main distributors, which aim to directly affect the final sales prices of refined sunflower oil.

Due to the fact that there is virtually no direct link between the three companies, the investigations between the offenders were divided into three separate proceedings. The first is over, against Zvezda AD, the decisions of the CPC are expected against the other two companies.

According to the Law on Protection of Competition, the decisions of the CPC are not subject to appeal. Within 30 days, the parties concerned shall object or be heard in camera.

It is also possible for the respondent parties to propose a system of measures that would lead to the termination of the vicious practice of cartel agreements.
