Just five years after the Commission for Protection of Competition (CPC) proved a cartel in the oil market, three of the major producers are again accused of cartel agreements is illegal trade practices.
In 2008, 13 companies in the sector were sanctioned in the amount of BGN 2 million, which in 2010. was reduced to BGN 893 thousand by a decision of the Supreme Administrative Court.
The producers of Kaliakra AD, Biser Oliva AD and Papas Oil were punished with the maximum amount of sanctions. Among the fined producers were also Zvezda AD, Zarneni Hrani Bulgaria AD, Oliva and others.
Now the CPC is again targeting the companies Kaliakra AD, Biser Oliva AD and Zvezda AD, which are accused of concluding prohibited agreements with their main distributors in order to directly influence the selling prices of refined sunflower oil.
In addition, the aim was to allocate markets on a non-market competitive basis, in the form of a restriction on the distributor's territory.
The production of the CPC was formed after a sector analysis of the competitive environment in the markets, production and trade of oilseed sunflower and refined, bottled sunflower oil. The commission examined mainly the clauses in the distribution contracts between the suppliers and their main distributors.
Due to the fact that there is no connection between the participants in the three distribution networks in question, the CPC has decided to continue the investigation of the cartel agreement in three separate proceedings.
By law, the CPC's rulings are not subject to appeal. The parties concerned have the right to object or to be heard in camera within 30 days. The Law on Protection of Competition also provides for the possibility for the respondent parties, together or separately, to propose different obligations that would lead to the termination of the cartel agreements.
