The company producer of refined sunflower oil Biser Oliva AD and its distributors - Velizara 2000 EOOD, MM Maleshkov EOOD, Zagora 2000 OOD and Familex OOD were fined a total of BGN 95,000 by the Commission for Protection of Competition (CPC).

The fine was imposed because of the existence established by the CPC of an agreement prohibited by law, by which the producers and suppliers had an impact on the final selling price of the products, thus distorting free competition on the market.

Biser Oliva AD together with two other companies came under the target of the Antimonopoly Commission in early April 2013.

The three companies producing refined sunflower oil - Biser Oliva AD, Zvezda AD and Kaliakra AD, were accused of concluding prohibited agreements with their distributors, the ultimate goal of which is to directly influence the sales prices of the oil.

Given the fact that there is no direct link between the three companies, the investigations against them were considered in three separate proceedings. In mid-July, the CPC fined Zvezda AD BGN 85,673 and COOP Trade and Tourism BGN 76,154 for an agreement between them.

The fine they will have to pay from Biser Oliva AD is BGN 51,432. Its distributors were fined as follows: Verizara 2000 EOOD - BGN 10,044, Familex OOD - BGN 10,681, MM Maleshkov OOD - BGN 14,730 and BGN 8,465 for Zagora 2000 OOD. The proceedings against the third infringing company - Kaliakra AD - have not been completed yet.

According to the Law on Protection of Competition, the decisions of the CPC are not subject to appeal. It is possible for the affected parties to file objections or be heard in closed session of the Antimonopoly Commission within 30 days.

In 2008, by a decision of the CPC, 13 companies in the sector were fined a total of BGN 2 million. Two years later, the Supreme Administrative Court of Bulgaria reduced the fines to BGN 893,000. Among the companies fined with the maximum amount of the fine provided by law were Kaliakra AD, Biser Oliva AD and Zvezda AD.
