The second highest court of the European Union annulled the decision of the European Commission (EC) of March 2010, which allowed the sale of genetically modified potatoes Amflora on the European market.
According to the court in Brussels, the Commission did not follow the basic procedural rules that offered GMO crops in the Union area.
In March 2010, the EC approved the cultivation of the genetically modified potato variety Amflora for the needs of industry in the European Union. Then began the cultivation of potatoes in Germany, Sweden and the Czech Republic.
The Amflora potatoes are the work of the German agro-chemical company BASF and were created to extract starch from them for the needs of industry.
They were not intended for human consumption.
Potatoes contained a special gene that was resistant to antibiotics, which ensured that they would not get into human food.
The decision on genetically modified potatoes was the first in 12 years to approve the cultivation of GMO crops in the EU. It provoked sharp resentment among environmental organizations.
Environmentalists have argued that the resistant antibiotic in Amflora potatoes is able to make people resistant to basic drugs widely used against a number of diseases.
Amphlora has not been grown in Europe since last year, as many analyzes have shown that farmers are abandoning many BASF-branded products precisely because of GMO potatoes.
It is rumored that the European Court is about to reject the Commission's proposal approving the cultivation of GMO maize developed by DuPont and Dow Chemical.
Farmers in France strongly welcomed the decision, as they have traditionally been the biggest opponents of the introduction of hazardous GMO products into agriculture.
Environmental organizations have said that the Commission has no choice but to withdraw its proposal to grow the new type of genetically modified maize, known as 1507, or will face a similar result as BASF's GMO potatoes.
